Rubbish Collection South Kensington Service Terms

These Terms and Conditions set out the basis on which we provide rubbish collection and waste removal services in South Kensington and surrounding areas. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Service means any rubbish collection, waste removal, bulky waste clearance, recycling, or related service provided by us.

Customer means the individual, business, landlord, tenant, managing agent, or other party who makes a booking for the Service or on whose behalf a booking is made.

Site means the property, premises, building, or location from which we are requested to collect rubbish or waste.

Waste means any rubbish, refuse, household waste, commercial waste, bulky items, garden waste, or other material presented for collection, excluding any prohibited or hazardous items as specified in these terms.

Booking means a confirmed request by the Customer for the Service, whether made online, by telephone, email, or other agreed method.

2. Scope of Service

We provide scheduled and one-off rubbish and waste collection services, including the loading, removal, and lawful disposal or recycling of Waste from the Site. The precise scope of the Service, including the approximate volume or weight of Waste to be collected and the charges payable, will be agreed at the time of Booking or at the point of collection where a revised quote is required.

We will use reasonable care and skill in providing the Service, and we will dispose of or recycle Waste at licensed facilities in accordance with applicable UK waste management regulations.

3. Booking Process

3.1 Bookings can be made by telephone, email, or via our online booking system where available. Bookings are subject to availability and are not guaranteed until confirmed by us.

3.2 When making a Booking, the Customer must provide accurate information, including but not limited to:

a. The full address of the Site and any access instructions.

b. A description of the Waste to be collected, including an indication of volume, type, and any bulky or heavy items.

c. The preferred date and time window for the Service.

d. Contact details for someone authorised to be present at the Site at the time of collection.

3.3 We may provide an estimated quote based on the information supplied at the time of Booking. This estimate may be revised on arrival at the Site if the actual nature or quantity of Waste differs from the description originally provided.

3.4 By confirming a Booking, the Customer warrants that they are the owner of the Waste or have full authority from the owner to arrange for its removal and disposal.

4. Access to the Site

4.1 The Customer must ensure that we have safe, timely, and reasonable access to the Site at the agreed time. This includes arranging any necessary permissions, parking, loading access, or entry codes.

4.2 If we are unable to gain access to the Site or safely carry out the Service due to circumstances within the Customer's control, we may charge a reasonable call-out or waiting fee, or treat the visit as a cancellation under section 8.

4.3 The Customer must ensure that the route to and from the Waste is clear and that the collection area is safe for our staff to work in. We reserve the right to refuse to collect Waste where we consider the conditions to be unsafe or unsuitable.

5. Customer Obligations

5.1 The Customer is responsible for:

a. Properly presenting the Waste for collection in accordance with our instructions.

b. Separating any recyclable materials where required.

c. Ensuring that no prohibited or hazardous items are included in the Waste unless previously agreed in writing.

5.2 The Customer must not include in the Waste any of the following without prior written agreement: asbestos, chemicals, solvents, oils, fuel, gas bottles, clinical or medical waste, paint in liquid form, explosives, firearms, or any other hazardous or controlled substances.

5.3 The Customer will indemnify us against any loss, damage, penalty, or liability arising from their failure to comply with these obligations, including any costs associated with the handling or disposal of prohibited items discovered in the Waste.

6. Pricing and Quotations

6.1 Prices for our rubbish collection services are generally based on volume, weight, access conditions, and the nature of the Waste. We may also take into account any additional labour required for dismantling or moving bulky items.

6.2 Any quotation provided prior to collection is an estimate only and is based on the information supplied by the Customer. We reserve the right to adjust the price on arrival if:

a. The Waste volume or weight is greater than estimated.

b. The Waste type is different from that described.

c. Access is more difficult or time-consuming than indicated.

6.3 Where a revised price is necessary, we will inform the Customer before beginning the collection. If the Customer does not agree to the revised price, we may cancel the Service and charge a reasonable call-out fee.

7. Payments

7.1 Payment terms will be confirmed at the time of Booking. Unless agreed otherwise in writing, payment is due on completion of the Service.

7.2 We accept payment by cash, debit or credit card, or other methods notified to the Customer. For account Customers, payment terms will be as agreed separately.

7.3 We reserve the right to request a deposit prior to the Service, particularly for large or commercial collections. Any deposit will be deducted from the final invoice.

7.4 All prices are quoted inclusive or exclusive of VAT as specified at the time of Booking. Where applicable, VAT will be charged at the prevailing rate at the date of invoicing.

7.5 If any payment is not made by the due date, we may charge interest on the overdue amount at the statutory rate and may suspend further services until full payment has been received.

8. Cancellations and Amendments

8.1 The Customer may cancel or amend a Booking by giving us reasonable notice by telephone or email.

8.2 If the Customer cancels a Booking more than 24 hours before the scheduled collection time, no cancellation fee will normally apply.

8.3 If the Customer cancels within 24 hours of the scheduled collection time, or if we are unable to carry out the Service due to the Customer's act or omission, we reserve the right to charge a cancellation fee or call-out charge to cover our costs.

8.4 We will use reasonable endeavours to accommodate any request to change the date, time, or details of a Booking, but such changes are subject to availability and may result in a revised quote.

8.5 In the unlikely event that we need to cancel or reschedule a Booking, we will notify the Customer as soon as reasonably possible and will offer an alternative appointment. We will not be liable for any indirect or consequential loss arising from such cancellation or rescheduling.

9. Performance and Timeframes

9.1 We will use reasonable efforts to attend the Site at the agreed time or within the stated time window. However, all times are estimates and may be affected by traffic, weather, operational, or other factors beyond our control.

9.2 Time shall not be of the essence in the performance of the Service, and we shall not be liable for any loss or inconvenience caused by minor delays in attendance.

10. Ownership of Waste and Disposal

10.1 Upon loading Waste onto our vehicle and subject to full payment of our charges, ownership of the Waste transfers to us.

10.2 We will transport and dispose of Waste at licensed facilities in accordance with applicable waste regulations. We may, where appropriate, recycle, reuse, or otherwise process Waste in line with good environmental practice.

10.3 We will provide or maintain appropriate waste transfer documentation as required by law.

11. Liability and Damage

11.1 We will exercise reasonable care when carrying out the Service. However, minor scuffs or marks may occasionally occur when removing bulky items from confined spaces, and the Customer acknowledges this risk.

11.2 Our liability for any loss or damage to property arising from our negligence shall be limited to the reasonable cost of repair or replacement, subject to any exclusions set out in these Terms and Conditions.

11.3 We shall not be liable for:

a. Any pre-existing damage or defects at the Site.

b. Any loss or damage arising from inaccurate information provided by the Customer.

c. Any indirect or consequential loss, including loss of profit, loss of business, or loss of opportunity.

11.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited.

12. Waste Regulations and Compliance

12.1 We operate in compliance with relevant UK waste management legislation and regulations. We will hold and maintain any licences or registrations required to collect and transport controlled waste.

12.2 The Customer agrees to cooperate with us in meeting any legal requirements, including providing information about the origin and nature of the Waste, and allowing us to complete any necessary documentation.

12.3 Where the Customer is a business, organisation, or landlord, they remain responsible for fulfilling their own duty of care in relation to waste, including the requirement to ensure that Waste is transferred only to an authorised carrier and that correct records are kept.

13. Complaints and Disputes

13.1 If the Customer is dissatisfied with any aspect of the Service, they should contact us as soon as possible, providing full details of the issue.

13.2 We will investigate any complaint and seek to resolve the matter promptly and fairly. Where appropriate, we may offer a remedy such as a partial refund or a return visit to complete or rectify the Service.

13.3 If a dispute cannot be resolved by mutual agreement, the parties may consider using mediation or another form of alternative dispute resolution before resorting to legal proceedings.

14. Data Protection and Privacy

14.1 We will process any personal data provided by the Customer in connection with the Service in accordance with applicable data protection laws.

14.2 We will use personal data only for the purposes of managing Bookings, providing the Service, handling payments, and dealing with enquiries or complaints, unless otherwise agreed with the Customer or required by law.

15. Events Beyond Our Control

15.1 We shall not be liable for any delay in or failure to perform the Service where such delay or failure is due to an event beyond our reasonable control, including but not limited to severe weather, traffic disruption, industrial action, accidents, or restrictions imposed by authorities.

15.2 If an event beyond our control affects the performance of the Service, we will notify the Customer as soon as reasonably practicable and will take steps to minimise the effect of the delay where possible.

16. Variation of Terms

16.1 We may amend these Terms and Conditions from time to time. Any changes will take effect for new Bookings made after the date on which the updated terms are published or otherwise notified to the Customer.

16.2 The Terms and Conditions applicable to a particular Booking will be those in force at the time that Booking is confirmed.

17. Severability

17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining provisions, which will continue to be valid and enforceable.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of our rubbish collection services, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or in connection with these Terms and Conditions or their subject matter.
